MY CAUDALIE TERMS

1. Object

CAUDALIE, a limited liability company (SAS) with a capital of 1,011,800 euros and head office located at 6, Place de Narvik – 75008 Paris, registered in the Paris Trade and Companies Register under number 398 360 123, has a customer loyalty program that operates through its www.caudalie.com.

 

The MYCAUDALIE Loyalty Program allows customers who buy certain Caudalie products to accumulate loyalty points in their Caudalie customer account, which can then be exchanged for gifts and/or benefits.

2. Membership of the MYCAUDALIE Loyalty Programme

2.1 Membership conditions

Membership of the MYCAUDALIE Loyalty Program is free of charge. Only adult persons over 18 years of age, residing in Metropolitan France or in one of the following countries may join the Loyalty Program:

 

• Germany

• Austria

• Belgium

• Spain (excluding Canary Islands)

• Greece

• Italy (excluding Pantaleria)

• Luxembourg

• Monaco

• The Netherlands

• Poland

• Portugal (excluding Madère & Açores)

• United Kingdom (excluding Jersey, Guernsey)

• Russia

• Switzerland

• Turkey

• United States of America

• Canada

• Brazil

• Hong Kong

• Korea

• China

 

Those considered members of the MYCAUDALIE Loyalty Program are natural persons who have created an account on the website www.caudalie.com and have entered at least one unique MYCAUDALIE code or have automatically accumulated MYCAUDALIE points by making a purchase in a Caudalie Spa Boutique or at caudalie.com. A person may subscribe to one account only (same last name, first name(s) and address).

 

A unique MYCAUDALIE code is a single series of 10 or 12 digits and letters, found only inside Caudalie product boxes included in the MY CAUDALIE program.
(In general, all products with a secondary box)

 

All Caudalie products (with or without boxes) purchased on the caudalie.com website or in Caudalie Spa Boutiques automatically accumulate loyalty points.

2.2 Terms of Use

The MYCAUDALIE Loyalty Program is a program designed to provide benefits to Caudalie’s loyal customers. Creating a MYCAUDALIE account automatically implies full unconditional acceptance of these rules.
CAUDALIE may in no case be held responsible for non-receipt of a loyalty offer by the Member.

 

It is the Member’s responsibility to maintain all information relating to themselves up-to-date on their personal MYCAUDALIE space, on their caudalie.com account. CAUDALIE may in no case be held responsible for non-receipt of a loyalty offer by the Member.

 

It is the Member’s responsibility to maintain the information relating to themselves up-to-date on their personal MYCAUDALIE space on www.caudalie.com.

CAUDALIE may in no case be held responsible for non-receipt of a loyalty offer by the Member.

3. Personal Data

The personal data fields that are collected are compulsory and required to take advantage of the various benefits of the MYCAUDALIE Loyalty Program.

 

By subscribing to the MYCAUDALIE Loyalty Program, the Member consents to the use of their personal data by CAUDALIE in the context of this program, in particular in order to send them offers and information. A Member of the program allows CAUDALIE to carry out all the necessary checks regarding their identity or their home address.

 

In accordance with the provisions of the Act relating to computing, files and freedoms of 6 January 1978, CAUDALIE has undertaken the declaration of its file to the CNIL. The Member has the right to access, oppose and correct this information by writing to Caudalie Customer Services Department, 6 Place de Narvik, 75008 Paris, France or sending an e-mail.

4. Earning MYCAUDALIE points

 When buying a Caudalie product in Caudalie stores or on www.caudalie.com, the loyalty points are added automatically to the account of the Member. When buying a Caudalie product in a Caudalie store, the Member is awarded points on a maximum of 12 units of the same reference per purchase. Above 12 units, no points are awarded.

 

When buying a Caudalie product which has a unique code at an accredited point of sale (excluding Caudalie Spa Boutiques), the Member of the Loyalty Program should log into their personal space on the www.caudalie.com website and enter the unique MYCAUDALIE code to benefit from the loyalty points to which their purchase entitles them. The Member cannot enter more than 10 unique MYCAUDALIE codes per month.

 

Points earned are credited to the Member’s personal account.

 

Each member shall have access to their points balance:

• on their account at www.caudalie.com

• by phone or email by contacting our Customer Relations Service

• in Caudalie Spa Boutiques with a sales advisor

 

Points are valid for a maximum period of 18 months from the date they are awarded. Earning new points following the purchase of a product that is part of the MYCAUDALIE program results in the validity of all the points already built up on the Member’s account being extended by 18 months.
Only the “WELCOME” points attributed when a new account is created expire after 2 months if no purchase is made or no unique code is entered during these 2 months.

 

The Member can earn extra points during occasional marketing promotions.

 

- With no product purchase registered on their caudalie.com account, the status will remain as “Insider”.
- With the first purchase registered on their caudalie.com account, customers will receive “Member” status and benefits, in particular free points on their birthday.
- If, in addition to a purchase registered on their account, the customer has accumulated over 300 points in the past 12 months, the customer will be considered “VIP”. VIP status is fixed for one year from the moment when over 300 points have been accumulated within 12 months. It will be automatically extended after 12 months if the customer has accumulated 300 points again in the previous 12 months; otherwise, the “VIP” customer will move back to “Member” status. VIP status gives customers the right to free shipping for all orders on the caudalie.com website.

• Account creation (20 welcome points valid for 2 months)

• Realization of the beauty profile online for the first time (20 points)

• Recycling of your empty Caudalie products in store (within the limit of 150 cumulative points per member per year)

• Various promotional operations

5. Converting MYCAUDALIE points

The points accumulated and credited to the Member’s account may only be exchanged for gifts or benefits listed in the “Choose my gift” section, in the Member’s personal space and while stocks last. Each country can personalize the catalogue of MYCAUDALIE loyalty benefits which can change over time. Some services and surprises (invitations to events) may not be listed in this section.

 

In order to benefit from his/her gift(s), the Member can choose to:

• Include it(them) in an online order of products

• Collect it (them) from the chosen accredited point of sale, on presentation of the exchange voucher within 30 days, while stocks last.

6. Changes to the MYCAUDALIE loyalty programme

CAUDALIE reserves the right to change or withdraw, at any time, the MYCAUDALIE Loyalty Program (membership terms, benefits, etc.).

 

CAUDALIE reserves the right, in order to prevent fraud, to deactivate the account of a Loyalty Program Member without the person concerned being able to claim any compensation, of any kind, in particular in the case of an unusually high number of entries of MYCAUDALIE codes on the same day and/or over several days. CAUDALIE reserves the right to perform checks at any time on observance of the rules.

7. Fraudulent use

Any breach of these rules, any fraudulent use by the Member of the MYCAUDALIE Loyalty Program or by any third party acting on behalf of the Member, shall automatically lead to the deactivation and deletion of the loyalty account without compensation or indemnity of any kind.

CAUDALIE reserves the right, in order to prevent fraud, to deactivate the account of a Loyalty Program Member without the person concerned being able to claim any compensation, of any kind, in particular in the case of an unusually high number of entries of MYCAUDALIE codes on the same day and/or over several days. CAUDALIE reserves the right to perform checks at any time on observance of the rules, and in particular to make the reactivation of a loyalty account subject to the provision of proof of purchase of products in the event of suspected fraud.

8. Non-Waiver

Failure by either party to act under this by-law does not constitute a waiver of the right to act, except in the event of an express or written waiver.

9. Applicable Law

These rules are governed by French law.

 

Should any of the stipulations of these rules be ruled as being invalid, void, or inapplicable for any reason, this stipulation shall be regarded as separable from the rest of the rules and shall not affect the validity and the applicability of the other stipulations.

10. Competent courts

In the absence of agreement, the French courts shall have exclusive jurisdiction with respect to any dispute relating to the interpretation and implementation of these rules.
